BrightShare is committed to permission-based email marketing practices, and has instituted the following zero-tolerance Anti-Spam Policy. BrightShare reserves the right to amend this Anti-Spam Policy as it deems necessary, and the amended Anti-Spam Policy will be updated and posted.
BrightShare makes reasonable commercial efforts to conform to the Federal Trade Commission’s CanSpam Act. Accordingly, BrightShare expressly prohibits the promotion and marketing of any gaming merchant within its Affiliate Program by the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial email (“Spam”). Under no circumstances may an Affiliate deliver Spam or cause Spam to be delivered to any player or prospective player.
BrightShare does not authorize the harvesting, mining or collection of player email addresses or other player information, as the foregoing constitute BrightShare’s confidential and proprietary information. Affiliates are also subject to the BrightShare Privacy Statement.
BrightShare does not permit or authorize any Affiliate to promote and market one or more of the gaming merchants within the Affiliate Program in a manner that could damage, disable, overburden or impair the gaming merchant, BrightShare, any other BrigthShare Affiliate, or that could interfere with any player’s use and enjoyment of the gaming merchants’ services.
Each violation of the above provisions is subject to fine up to a maximum of US$10,000. Deceptive commercial email is also subject to laws banning false and misleading advertising. Furthermore, the Department of Justice is allowed to seek criminal penalties, including imprisonment, against senders of commercial emails that fail to adhere to (or conspire to violate) the provisions set forth in this Anti-Spam Policy.
You expressly understand and acknowledge that failure to adhere to this Anti-Spam Policy shall subject you to such actions as BrightShare, in its sole discretion, deems appropriate including, without limitation: (i) the voiding of any Affiliate earnings to which you may/are otherwise entitled, (ii) the termination of your Affiliate status, (iii) the imposition of fines, and/or (iii) the reimbursements for damages and expenses which BrightShare or its clients may incur as a result of your conduct.
BrightShare’s failure to enforce this policy in every instance does not amount to a waiver of BrightShare's rights hereunder.
